In the digital age, millions of travelers rely on online travel aggregators and booking platforms to plan their vacations. Trusting glossy pictures, ratings, and locations, consumers often make advance payments without a second thought. However, arriving at a destination only to discover that the booked hotel does not even exist can turn a dream holiday into an absolute nightmare.
A shocking case from Gurdaspur, Punjab, has highlighted the grave risks and accountability gaps in online hotel bookings. A family that traveled to Kashmir for a winter vacation found themselves stranded in freezing weather due to non-existent properties listed on a major booking portal. The incident led to a legal battle, resulting in a strict penalty imposed by the consumer dispute redressal commission against the service provider.
Missing Hotels: From Srinagar to Gulmarg
Rajesh Chauhan, along with his wife and two children, planned a holiday to the scenic valleys of Kashmir using MakeMyTrip. As per their itinerary, they booked a family room at 'Hotel Heritage Rose Inn' in Srinagar for December 27-28, paying Rs 5,788. For the following night, December 28-29, they booked rooms at 'Hotel Apple Tree Resorts' in Gulmarg, paying Rs 12,987.
Upon reaching Srinagar, the family searched for the hotel at the provided address, only to find a private homestay instead of the promised hotel. The situation worsened when they reached Gulmarg the next day, where the second booked hotel, 'Hotel Apple Tree Resorts', had no physical existence at all.
Trapped in Freezing -4°C Temperatures
With heavy snowfall and temperatures plunging to minus 4 degrees Celsius, the family was left stranded without shelter in sub-zero weather. Unable to find their booked accommodation, they were forced to spend the entire night inside their personal car to survive the biting cold.
Traumatized and physically exhausted, the family had to cancel their scheduled Gondola cable car ride and return to Gurdaspur the very next day without completing their vacation.
Consumer Commission Rejects Platform's Defense
When the family sought a refund and assistance from the booking platform, they received no satisfactory response. Consequently, they approached the District Consumer Disputes Redressal Commission in Gurdaspur. During the proceedings, the company argued that it was merely an intermediary platform and should not be held liable since it did not own or operate the hotels directly.
The consumer commission outrightly rejected this defense, ruling that since the consumer made full payment directly to the platform and received confirmed booking vouchers, the platform cannot wash its hands of its responsibility. The commission noted that labeling the situation as a 'no-show' was absurd when the property itself did not exist.
Compensation Ordered and Key Takeaways for Travelers
Holding the company guilty of deficiency in service and unfair trade practices, the Gurdaspur consumer commission ordered MakeMyTrip to pay a total compensation of Rs 48,775 to the aggrieved consumer. This includes a refund of the booking amount with 9 percent annual interest, compensation for mental and physical harassment, and litigation costs.
