The Legal Battle Over UP 69000 Teacher Recruitment
The high-profile Uttar Pradesh 69,000 assistant teacher recruitment case has reached a crucial stage in the Supreme Court. During the recent hearings, senior advocates representing the general category teachers currently in service presented strong arguments before the bench, challenging the previous high court directives.
A bench comprising Justice SVN Bhathi and Justice NV Anjaria is hearing petitions filed by unreserved category teachers challenging the August 13, 2024 order of the Allahabad High Court division bench. The division bench had previously quashed the selection list and ordered the state government to prepare a fresh merit list within three months.
Arguments on Double Reservation and Eligibility Relaxation
Presenting the case for the in-service general category teachers, Senior Advocate Shobha Gupta argued that her clients were selected fairly and strictly according to the rules. She contended that the reserved category candidates are enjoying the benefit of reservation twice at different stages of the examination process.
"The reserved category candidates took relaxations in age, application fees, and passing marks during the TET examination, and they are claiming relaxations yet again in the main recruitment written examination." — Shobha Gupta, Senior Advocate
The counsels argued that providing multiple relaxations at consecutive stages disrupts the balance of the selection process and infringes upon the rights of general category meritorious candidates.
Background and Future Outlook
The Supreme Court had earlier granted an interim stay on the Allahabad High Court's order, providing temporary relief to thousands of teachers currently employed in schools across Uttar Pradesh. Apart from the general category teachers, reserved category candidates have also filed intervention applications in the apex court to defend their stance.
As the hearings continue, the final verdict of the Supreme Court is expected to have far-reaching implications for teacher recruitment policies and the interpretation of reservation rules in the state.
