Himachal High Court Mandates Higher Education Allowance for Specialist Doctors
In a significant legal development, the Himachal Pradesh High Court has delivered a strong verdict in favor of specialist medical officers serving within the state's health and family welfare department. The court has directed the administration to immediately disburse the due monthly higher education allowance of Rs 7,000 to the eligible doctors, pulling up the authorities for withholding legitimate financial benefits on technical pretexts.
Justice Jyotsna Rewal Dua accepted the petitions filed by Dr. Vinod Gupta and other medical professionals, mandating that the entire payment process along with arrears must be completed within a strict timeframe of four weeks. The ruling emphasizes that administrative delays or procedural sluggishness in amending service rules cannot be used as an excuse to deprive government-sponsored specialist doctors of their rightful dues.
Court Dismisses Administrative Flaws and Selective Denial
During the legal proceedings, it was highlighted that the state government itself had sponsored these doctors under its 2019 postgraduate policy to pursue specialized degrees such as Geriatrics and Emergency Medicine from prestigious institutions like AIIMS Rishikesh. Upon successful completion of their courses, they were deployed as specialists and senior residents in various hospitals across the state.
When these practitioners applied for the monthly higher education allowance under a 2013 notification, the department initially resisted by claiming their specific specializations were missing from the 2002 recruitment rules. However, the court took strong note of the fact that similar allowances had previously been granted to other doctors possessing comparable postgraduate qualifications, terming the discriminatory approach unacceptable.
