The Enforcement Directorate (ED) has initiated decisive action in a major money laundering case involving industrialist Anand Jain's company, Jay Corp Limited, and other associated entities. The ED's Mumbai Zone-II office has provisionally attached 88.47 acres of prime land in a significant region of Maharashtra, valued at approximately ₹336 crore in the current market. This action has been carried out under the stringent provisions of the Prevention of Money Laundering Act (PMLA), 2002, which provides a robust legal framework to combat financial crimes and seize assets acquired through illegal means.
The Genesis of the Case
The ED's investigation stems from an FIR registered by the CBI (Central Bureau of Investigation) EOB (Economic Offences Wing), Mumbai. This FIR was lodged following an order from the Bombay High Court on January 31, 2025, which mandated a thorough probe into allegations of financial irregularities, fund diversion, and money laundering. The investigation revealed that in 2006-07, Jay Corp Limited launched the Urban Infrastructure Venture Capital Fund (UIVCF). Through this fund, a substantial amount of approximately ₹2,434 crore was raised from a large number of investors, including public sector banks and other government financial institutions. The primary objective of this fund was to invest in various Special Purpose Vehicles (SPVs) for real estate projects across the country.
However, the subsequent investigation unearthed serious irregularities. The ED alleges that the fund's tenure was extended beyond the stipulated period without the necessary approval from the Securities and Exchange Board of India (SEBI). Upon becoming aware of these violations, SEBI instructed the fund to wind up operations and directed that the assets held in the fund's SPVs be independently valued to provide an exit option for investors. This directive was crucial for ensuring transparency and protecting the interests of the investors.
Allegations of Fund Manipulation and Attachment Process
The ED's probe further unveiled that, allegedly in collusion with the UIVCF management, the actual value of the fund's stake in the SPVs was deliberately understated. For instance, it was shown as merely ₹269.20 crore, significantly less than its fair market value. Investors were reportedly given an exit based on this undervalued assessment, leading to substantial losses for them.
The agency specifically highlighted an SPV named Neelkanth Township & Constructions Private Limited. UIVCF had invested ₹51 crore in this company, which was primarily utilized for purchasing land in Alibag, Maharashtra. The ED alleges that the fund's stake in this particular SPV was also shown at a value considerably below its fair market value. Subsequently, five entities linked to the promoters of Jay Corp acquired these units at a significantly reduced price. This alleged transaction is said to have generated approximately ₹230 crore as "proceeds of crime." Based on this, immovable properties of the SPV, valued at ₹230 crore as of October 31, 2022, have been provisionally attached. The current market value of these attached assets now stands at ₹336 crore. This attachment is a critical step under the PMLA, which empowers the agency to seize properties derived from or involved in money laundering.
This is not the first instance of action by the ED in this case. Earlier search operations had resulted in the seizure of approximately ₹1.86 crore in cash, while funds totaling around ₹99.47 crore in demat accounts and mutual funds were frozen. The ED has clarified that further investigation in the matter is ongoing, and this provisional attachment serves as a significant measure under the allegations of money laundering and acquisition of proceeds of crime that surfaced during the probe. This action underscores the government's firm stance against financial fraud and money laundering.
