Hope Parties Will Act Sensibly: Supreme Court Refuses Immediate Order on CJP Protest in Connaught Place

The Supreme Court of India has refused to issue immediate emergency directives regarding the proposed protest by the Cockroach Janata Party (CJP) near Connaught Place in New Delhi. During the hearing, the bench emphasized the importance of maintaining public order while expressing concern over the potential economic impact on small vendors and local shopkeepers.

CJI Emphasizes Livelihood and Prudence

During the proceedings, the Chief Justice stated that the court expects all parties and protesters to act with utmost responsibility and good sense. Highlighting the plight of small business owners, the bench noted that daily earnings are crucial for running their households, and the judiciary remains fully cognizant of the hardships they might face due to sudden disruptions.

The court also observed that the Delhi High Court is already seized of connected matters. The bench pointed out the delicate balance between the right to demonstrate and the absolute necessity of maintaining peace and public order in the national capital.

NDMC's Park Closure and Compensation Concerns

Counsel for the petitioner informed the bench that the New Delhi Municipal Council (NDMC) had issued orders closing Central Park, thereby halting commercial activities and causing financial distress to local hawkers and vendors.

Addressing this, the apex court remarked that if administrative actions lead to unwarranted business losses, the judiciary holds the constitutional authority under public law to consider matters of compensation. The court indicated that these grievances could be formally raised once normal access is restored.

Next Hearing Scheduled for October 26

While declining to pass a blanket restraint order against the protest at this stage, the Supreme Court kept the option of addressing livelihood damages open. The matter has been listed for further hearing on October 26, where affected parties can present their claims regarding business losses.
